Divorce may be loosely used today as a way to terminate a marriage however in truth, it is the last stage for the dissolution of marriage. It takes away all the legal issues that bind two individuals when they were married. Divorce however isn’t in all countries. Some do not allow for divorce at all while some need a tougher set of regulations as with annulment.
People who wish to terminate their marriage should first know all the options that are available to them. Couples may either go for divorce, legal separation or annulment. The three are vastly different even though all are procedures that can end a marriage.
Divorce, as I’ve already explained, terminates the marriage and the legal duties and obligations that a couple has for each other. It cancels the marital status of the parties involved and enables them to get married again should they wish. It’s much easier to get a divorce in the united states than say annulment. This is the reason many people would certainly be satisfied with this than move through the rougher battle of having an annulment. Really the only tough thing with this procedure is when it relates to infant custody. Most of the time, the battle for custody is what makes the process hard.
An annulment, conversely, declares the marriage null and void. In declaring this, the marriage will be declared to have not happened at all! Normally, the terms that may make an annulment possible are not as easy like for instance, marriage when you are underage and there is no consent from the parents for the marriage or when the marriage was held under false pretenses. Usually, these conditions include falsehoods, non-declaration of legal commitments or not staying with the legal terms of marriage.
Legal separation can be considered as a notch below divorce when it comes to removing all legal obligations and duties. It is however tougher to get one. In legal separation, the couple agrees to reside apart but will still support each other and also have legal commitments to one another. As with married people, their assets continue to be bound together. Also, they are not permitted to marry someone else until they get a divorce or an annulment.
But for most of us, there’s actually no need for these legal commitments to continue. Thus, most Americans opt for divorce. One cannot really blame them. It is easier and faster with less the fuss.
